Andrew Malkinson

Andrew Malkinson of Salfond (UK) spent 17 years in a prison for a crime he did not commit.

The police arrested Malkinson for a rape because they thought he matched the description left by the victim. He was sentenced in 2004 and was released from prison in 2020. He could have had his sentence reduced if he had admitted his guilt, but he did not.

With the help of the law charity APPEAL, he found evidence of violations during the investigation. Lawyers of Malkinson found that the police did not check all the suspects who could match the description. Malkinson did not fully match the description, as he was taller than the attacker. It was also found that one of the two witnesses who testified against Malkinson had been convicted of fraud, and that the jury was not told of this.

In July 2021, a witness stated that police pressured her to testify against Malkinson. Moreover, the attacker’s DNA did not match Malkinson’s DNA. In April 2022, Malkinson said that despite being released from prison, he could not return to a normal life. He stated that he could not get a job due to a criminal record.
