After 20 years of fighting for his innocence – 17 of them from inside prison – 57-year-old Andy Malkinson’s conviction was overturned on July 26, 2023. The Crown Prosecution Service did not contest his appeal in a case that raises serious questions about why he was jailed in the first place.
The Court of Appeal’s decision came after DNA testing implicated another man in the crime. No forensic evidence links Mr. Malkinson to the 2003 rape.
Andy Malkinson is convinced that documents proving his innocence were deliberately withheld by police officers all these years. Now the man intends to seek justice in court.
MASS MEDIA ABOUT THE CASE:
On 26 July 2023, the Court quashed Mr Malkinson’s wrongful conviction for rape, for which he spent over 17 years in prison, in view of new DNA evidence implicating another suspect.
The Initiative Group has sought clarification on the current case from the Minister for Justice and Lord Chancellor Dominic Raab and the UK Secretary of State for the Interior, Suella Braverman. The Initiative Group believes it is important to fight against judicial arbitrariness and can provide legal and informational assistance to Andy Malkinson if necessary.
