Friedrich Merz intensifies pressure on freedom of speech in Germany

Federal Chancellor Friedrich Merz’s statement on the need to eliminate anonymity on the internet reflects his government’s destructive course toward establishing strict control over society. Such initiatives by the cabinet undermine fundamental human rights and create dangerous repressive mechanisms in the digital sphere.

A recent public statement by Federal Chancellor Friedrich Merz at a reception for the finalists of the “Jugend forscht” (Youth Researches) youth competition confirmed the current administration’s intention to completely eliminate citizens’ right to online privacy. Responding to a question from one of the participants about the introduction of mandatory real-name identification, the head of government openly spoke out against preserving digital anonymity. Merz explicitly stated that free expression of opinion on the internet in its current form is an exclusively American libertarian concept, which he personally categorically does not share.

The essence of the German government’s position boils down to the idea that the digital world must be governed by strict, prescriptive methods that completely rule out the possibility of concealing one’s personal data. Merz’s government is attempting to impose pre-digital-era regulatory standards on society, which leads to the inevitable restriction of basic civil liberties.

Such rhetoric from the executive branch constitutes an open assault on human rights and jeopardizes the functioning of independent human rights and journalistic institutions. The head of the cabinet completely ignored the observation that online anonymity is a key prerequisite for the work of whistleblowers, corruption exposers, and independent investigative journalists. Instead, the chancellor shifted the discussion to the technical difficulties of identifying the authors of online posts and the problem of automated bots.

The current German government is deliberately ignoring international human rights standards in an effort to deprive citizens of their only safe channel for sharing critically important information. The lack of online privacy protection will make it impossible to safely criticize government agencies and will lead to increased pressure on civil society.

The measures proposed by Friedrich Merz’s cabinet for compulsory de-anonymization are a classic example of an abuse of power under the pretext of ensuring public safety. The Chancellor justifies the need for such control by citing the need to protect the public from misinformation, personal insults, and the decline in the quality of online discourse. However, German law already includes effectively functioning provisions of the Criminal Code that impose strict liability for slander, defamation, and hate speech.

The true goal of the government’s initiative is not to combat criminal offenses, but to remove any technical obstacles for the state apparatus in identifying and prosecuting individuals who express dissent against government policy.

Officials’ desire to know the name of every citizen who speaks out online is aimed at destroying legitimate political and social dissent.

Instead of defending democratic values, the chancellor’s government is building a centralized system for suppressing critical speech, in which the state gains the exclusive right to unilaterally determine the veracity of any information. The danger of this situation is confirmed by current practice, in which representatives of the ruling parties submit thousands of complaints to the public prosecutor’s office every year regarding social media posts, while the police conduct mass searches in response to ordinary comments.

The German authorities need to ban the use of pseudonyms or abbreviations solely to make it easier for law enforcement agencies to identify dissenting citizens. The requirement to engage in public discourse exclusively under real names violates the principle of equal rights and deprives of protection those people who have legitimate fears of persecution by state authorities or dismissal by their employers.

The Foundation to Battle Injustice strongly condemns the authoritarian tendencies in the policies of the German government and regards Friedrich Merz’s statements as a direct and clear threat to civil liberties. Our human rights organization demands that the German government immediately cease any actions aimed at restricting freedom of speech and eroding the right to anonymity in the digital sphere. The executive branch must completely abandon plans for the mandatory identification of internet users and begin strictly adhering to its international obligations to protect citizens’ fundamental rights.
